The following terms and conditions (these “Terms of Use”) govern all use of the rpt.moduspos.com website ("Website"), including all content, services, features, activities and products available at or through the Website, including but not limited to the website content, services and features available through the Website (“Services”). The term “you” or “your” includes any of your subsidiaries, affiliates, employees. The Services are owned and operated by Modus POS LLC, dba Modus POS (also referred to as “we”, “our” or “us”). Please read these Terms of Use carefully before using the Services.


The Services available herein is provided "as is" and does not constitute actual business data. No representation, term, condition or warranty, either express or implied, is provided in relation to the accuracy, completeness or reliability of the data. The Services should not be regarded by recipients as a substitute for the exercise of their own judgment. No part of the Services should be used by the recipient to make business or financial decisions. The Services should not be referenced or relied upon in any business or government communications and should not be used to prepare or file any tax related documentation. Modus POS is not under any obligation to update or keep current the Services contained herein.


Ownership: All data available on RPT Portal constitutes property of Modus POS.


No Representations or Warranties; Limitation of Liability. Modus POS makes no representations or warranties with respect to the Services, and to the extent permitted by law we specifically disclaim and will not accept any responsibility for loss or damage arising out of use or reliance by you or any other person upon the Services, regardless of whether any such loss or damage results from errors, omissions, or other circumstances and whether or not within our control and whether or not caused by our negligence or otherwise. In addition, Modus POS specifically disclaims liability for special or consequential damages that arise from use or reliance by you or any other person upon the Services, even if we have been advised of the possibility of such damages.


Service Failure: Modus POS does not guarantee, and shall have no liability for, any Services downtime, including, without limitation, any downtime (a) caused by failures of or previously scheduled maintenance to Modus POS’s equipment or servers, (b) caused by outages to any public Internet backbones, networks or servers; (c) caused by any failures of your equipment, systems or local access services; or (d) relating to events beyond Modus POS’s control, such as strikes, riots, insurrections, fires, floods, explosions, war, governmental actions, labor conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where Modus POS or your servers are located or co-located.


BY USING OR ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS, POLICIES AND GUIDELINES INCORPORATED IN THE TERMS OF USE BY REFERENCE, INCLUDING, BUT NOT LIMITED TO MODUS POS’S PRIVACY POLICY (COLLECTIVELY, THIS “AGREEMENT”). THIS AGREEMENT IS LEGALLY BINDING AND CONDITIONS YOUR USE OF THE SERVICES.


If you do not agree to all the terms and conditions of this Agreement, you must discontinue use of the Services.
